Kim Zolciak is releasing an official statement regarding the lawsuit with Kandi Burruss over the song ‘Don’t Be Tardy For The Party.’ Kim suggests Kandi is using the lawsuit for publicity to launch her spin-off show, ‘The Kandi Factory.’ In the press release, Kim says she has paid Kandi and Don Vito in excess of $23,000 record sales. “The lawsuit led by Kandi Burruss and Rodney Richard aka Don Vito against Kim Zolciak-Biermann over the song “Tardy For The Party” is without merit and suspicious in its timing. We also find the handling of the lawsuit by another cast member on the show, and the timing of Kandi’s attempt to launch her own spinoff reality show, raises serious questions about the true motives behind the filing this lawsuit for alleged record royalties due from a song that was released over three and a half years ago.

The song was created by four people who share in the royalties: Kim, her daughter (who co-wrote the original song in season one of the RHOA show before Kandi joined the show in season two) Kandi and Don Vito.  To date, Kim has written checks to Kandi and Don Vito in excess of $23,000. In fact, we believe that Kim may have overpaid a portion of their share to date based on the actual record sales.

It is clear to us the lawsuit was brought solely for the purpose of publicity because the facts are not in Kandi’s favor. Kandi Burruss and her legal team are well aware of the truth regarding the song and the payments Kandi and Don Vito received from Kim.  That is a clear fact.

But we find the greatest truth in the fact that Kandi Burruss has been in the music business for many years and it appears she has made many mistakes in dealing with the song. We assume this has been a major lesson for Kandi. Maybe focusing on her next 15 minutes of fame should not have been the priority for Kandi versus three and a half years after the song was released, Kandi realizing she handled all aspects of the song in a very sloppy and messy way. We understand it is not the first time either.  As Kandi is also a music industry veteran, it is also a shame.”

  1. Boy, that last paragraph is just snarky, not informative: the mark of a sleazy attorney. I’m sure “the lesson” Kandi got that the attorney references here is to get it in writing, not rely on a friend’s handshake. Nevertheless, a verbal contract is as binding as a written one. I remember in at least one of the reunions, well after the song was out, Kim admitting she’d paid Kandi nothing as of then.

  2. First of all, as far as suspect timing – this lawsuit does not sway me one way or the other as to watching Kandi’s spin-off.
    Second, Kim always has to show her ass – never can she be classy about anything.
    Third – I see more of a problem for Kim than Kandi. I have never witnessed Kandi “lie” ever on this show. Kim…..all the damn time. If there was no written contract – looks like 2-against one, and the one (Kim) has no credibility – so – I would wager my bets on Kandi purely for that reason. Kim always talks out of both sides of her mouth. Her lawyer probably isn’t equipped with the truth. Gheez, film footage alone of the last 2 reunions shows what a dumbass loser Kim was about this whole issue. Yea, Kim, good luck with that.

  3. Sounds like Kandi let friendship get in the way of obtaining an ironclad producing agreement for this song and Kim’s lawyers have seized upon it.

  4. The only one set to loose is Kim. Kandi producing, recording, releasing and adding music to the song is all on film. As a producer, she owns the song (I think) and she can take it down if she wants.

  5. Kim you know Kandi did something wonderful for you and you agreed to pay her her dues. So man up and pay her if you want people to watch your new show than you are going to have to show us you are a up standing person. Kandi always stood up for you and you always believed what ever any one told you about her. So pony up and give Kandi what is hers… Show your grils how to be ladies you are their example, PLEASE do not show teach them to be money grabing b—-es, I know some where down in you you can do it. Please do not let your few fans down…..

  6. Kim, do you believe someone is gonna believe you over Kandi….get real girl. Tardy for The Party was a big flop before it was revamped by Kandi plus Kandi does not need publicity to launch her spin-off show because her show already has a fanbase because it was launched over a year ago.

Kim you needed Kandi on the song because clearly your voice sounded like sh** even with the autotune. Kandi had to sing the chorus and all and for you to attempt to degrade Kandi as an artist and music mogul…then why are you playing Kandi’s voice for your show theme song.
